1. Acceptance
By installing or using SyncGallery (package net.mapps.mgallery), you agree to these Terms of Service. If you do not agree, do not use the app.
2. Description of the service
SyncGallery is a photo and video gallery application for Android that provides media browsing, organizing, editing, and optional cloud synchronization with Google Drive and Microsoft OneDrive.
3. Eligibility
You must be at least 13 years old to use this app. If you are under the age of legal majority in your jurisdiction, you must have permission from a parent or legal guardian.
4. User accounts and cloud services
- Cloud synchronization features require you to sign in with your Google or Microsoft account. You are responsible for maintaining the security of your account credentials.
- The app accesses your cloud storage only within the folders you explicitly configure for synchronization.
- You may disconnect your cloud accounts at any time within the app settings.
5. Subscriptions and payments
- The app offers optional paid subscriptions via Google Play Billing.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
- You can manage or cancel subscriptions through Google Play Store settings.
- Refunds are handled according to Google Play's refund policy.
6. Acceptable use
You agree not to:
- Use the app for any unlawful purpose or in violation of any applicable laws.
- Reverse-engineer, decompile, or disassemble the app, except where permitted by law.
- Attempt to gain unauthorized access to the app's systems or third-party services connected to the app.
- Use the app to transmit malware or any harmful content to cloud services.
7. Intellectual property
- The app and its original content, features, and functionality are owned by Aliaksandr Kasabutski and are protected by copyright and other intellectual property laws.
- You retain full ownership of your photos, videos, and other media files. The app does not claim any rights over your content.
8. Privacy
Your use of the app is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
9. Third-party services
The app integrates with third-party services, each governed by their own terms:
- Google Terms of Service (Google Drive, Firebase, AdMob)
- Microsoft Services Agreement (OneDrive)
- Google Play Terms of Service (billing, distribution)
10. Disclaimer of warranties
The app is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the app will be uninterrupted, error-free, or free of harmful components.
11. Limitation of liability
To the maximum extent permitted by applicable law, Aliaksandr Kasabutski shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the app. In particular:
- We are not responsible for data loss resulting from cloud synchronization failures, device malfunctions, or third-party service outages.
- The app performs file operations (including uploads, downloads, and deletions) only as configured and approved by you through your sync rules and in-app actions. We are not liable for any data loss resulting from file operations that you initiated, configured, or approved.
- You are responsible for maintaining backups of your important data.
12. Operation logging and dispute resolution
The app maintains a local operation log on your device that records file operations performed during synchronization. This log is provided for your convenience and transparency. In case of any dispute regarding file operations, the operation log may serve as a reference. However, the log is stored locally on your device and is not transmitted to or retained by us.
13. Changes to these terms
We may update these terms from time to time. The updated version will be posted at: https://m-apps.net/syncgallery/html/en/syncgallery_terms.html. Continued use of the app after changes constitutes acceptance of the new terms.
14. Governing law
These terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
